Terms of Service

These terms govern access to and use of Movira360 websites, applications, services, and integrations.

These Terms of Service form an agreement between the organization or person accepting them (“Customer” or “you”) and Movira360 (“Movira360,” “we,” or “us”). If a separate signed agreement applies, that agreement controls to the extent of a conflict.

Authority to accept

If you use Movira360 for an organization, you confirm that you have authority to bind that organization and that its authorized users will follow these terms.

1. The service

Movira360 provides venue-management capabilities that may include catalog, bookings, capacity, customers, payments, waivers, forms, point of sale, workforce, CRM, marketing, communications, reporting, and integrations. Available modules depend on the customer’s subscription, region, configuration, provider connections, and user permissions.

2. Accounts and access

  • Provide accurate account and organization information.
  • Keep login credentials confidential and use appropriate multi-user access rather than sharing accounts.
  • Assign each user only the locations, roles, and permissions needed for their work.
  • Notify Movira360 promptly about suspected unauthorized access.
  • You are responsible for activity performed through your authorized accounts unless caused by Movira360’s breach of these terms.

3. Customer data and instructions

You retain ownership of information submitted to the service. You grant Movira360 the rights necessary to host, process, transmit, back up, and display that information to provide and secure the service.

You are responsible for the legality, quality, notices, consents, retention choices, and instructions associated with your data, including guest, employee, waiver, communication, marketing, and imported data.

4. Acceptable use

You must not:

  • Use the service unlawfully, fraudulently, deceptively, or to harm another person.
  • Send spam or communications without required consent, identification, or unsubscribe mechanisms.
  • Upload malware, probe security without authorization, bypass access controls, or interfere with service operation.
  • Attempt to access another customer’s data or connect social accounts you are not authorized to manage.
  • Reverse engineer, resell, copy, or exploit the service except as permitted by law or written agreement.
  • Use automated means that impose unreasonable load or evade limits, quotas, or provider policies.

5. Communications and connected platforms

You are responsible for message content, recipients, consent, sender identity, suppression handling, and compliance with applicable marketing, privacy, and platform rules. Connected services such as Meta, email providers, and payment providers also apply their own terms and may restrict, reject, suspend, or delay activity.

Disconnecting a provider may stop new synchronization or delivery. It does not recall messages already sent or remove records that must be retained for legitimate business or legal purposes.

6. Payments, fees, and taxes

Subscription fees, billing cycles, usage charges, provider charges, and payment terms are set out in the applicable order, plan, or signed agreement. Unless required by law or the agreement, fees are non-refundable. Customers are responsible for applicable taxes and for their relationship with guest payment providers.

7. Availability and changes

We work to provide a reliable service, but uninterrupted availability is not guaranteed. Maintenance, emergencies, internet failures, provider outages, security events, legal requirements, or customer configuration may affect access. We may improve, replace, limit, or discontinue features while respecting applicable contractual commitments.

8. Third-party services

Integrations are operated partly by third parties. Movira360 is not responsible for third-party services, content, outages, policy changes, account eligibility, or actions outside our control. You authorize the exchange of information required for integrations you activate.

9. Confidentiality

Each party will protect the other party’s non-public business, technical, and security information using reasonable care and use it only for the relationship. Confidentiality does not apply to information lawfully known without restriction, independently developed, publicly available without breach, or properly received from another source.

10. Intellectual property

Movira360 and its licensors retain all rights in the service, software, designs, documentation, trademarks, and improvements. No rights are granted except the limited right to use the service during the applicable subscription. Feedback may be used to improve the service without restriction or obligation.

11. Suspension and termination

We may suspend access when reasonably necessary to address security risk, unlawful use, material breach, unpaid amounts, provider restrictions, or harm to the service or others. Where practical, we will provide notice and an opportunity to correct the issue. On termination, access ends and data is handled under the agreement, retention requirements, and Privacy Policy.

12. Disclaimers

Except for express warranties in a signed agreement and to the maximum extent permitted by law, the service is provided “as is” and “as available.” Movira360 does not provide legal, tax, accounting, employment, safety, or regulatory advice. Customers remain responsible for venue operations and professional review of their policies and configurations.

13. Liability

Liability limits, exclusions, and remedies in an applicable signed agreement control. Where no signed agreement states otherwise, each party’s liability is limited to the maximum extent permitted by law, and neither party is liable for indirect, special, incidental, punitive, or consequential damages, or lost profits, revenues, goodwill, or data, except where such limits are prohibited.

14. General

You may not assign these terms without our consent except as part of an approved business reorganization. We may assign them in connection with a merger, acquisition, reorganization, or sale of assets. If part of these terms is unenforceable, the remainder continues. Failure to enforce a term is not a waiver.

Governing law and dispute terms are those in the applicable order or signed agreement. If none are specified, contact us before relying on the service so the contracting entity and governing terms can be confirmed.
